    good day! where can we get a copy of this comprehensive compilation of city ordinances? this is a very useful tool for us to be informed and guided of the city laws. moreover, this will also serve as model and guide to other LGUs on what relevant matters that needs legislation especially those that affect the economy, environment, employment among others. kudos to this initiative and effort of the city govt of davao.

      Sir/Maam, due to the limited copies available of the Code of Ordinances of Davao City as we have already distributed copies to the different government agencies and offices as well as to the Local Government Units (LGUs) coming into the city, may we refer you to the Code of Ordinances Page in this blogsite.

      However, duly certified machine –copies of specific resolutions and ordinances may be printed in our office for a specified fee but is available free of charge to government agencies/offices. Thank you.

        Sir, we are still in the process of uploading the said ordinance in this blogsite. If you look it up on our home page and click on the link LANDMARK LEGISLATION ONLINE, you will find the title of the ordinance but with no scanned document found. Said ordinance contains seventy-seven (77) pages and is a very large file.

        However, per our Resolutions & Ordinances Tracking System (ROTS) Head, Ordinance 078, Series of 2000, will be uploaded anytime next week.

        Sir/Maam, Chapter IV, Article I, Section 237 under Secretary’s Fee of the 2005 Amended Revenue Code of Davao City provides that certified true copies of approved resolutions and ordinances will be subject to the following fees:

        First Page – P 25.00
        Succeeding Pages – P 10.00/page.

        You only have to go to our office and fill up the requisite request form. Thank you.

      Sir, copies of approved resolutions/ordinances are available for free for government agencies and for LGUs. Just send us the official email address of your office, city or municipality so that we can send you an ecopy of the same.

      However, if you come from the private sector, the 2005 Amended Revenue Code of Davao City requires that the certified true copies of approved resolutions and ordinances are subject to the following fees:

      First Page – P 25.00
      Succeeding Pages – P 10.00/page.

      The requested ordinance contains 16 pages and as such, you are required to Pay One Hundred Seventy-Five Pesos (P 175.00).

      Please send somebody to the office to facilitate your request as payments cannot be made online.

  6. Good day., i would just like to ask if is there really a city ordinance for banning aftermarket pipes for motorcycles?. I tried to contact LTO but they haven’t replied yet. If there is a City Ordinance then where do I get an IRR if there is any… Thank you..

      Maam/Sir, as per check with our records, Item No. 351, re: A resolution enacting an Ordinance prohibiting the sale of junk foods within school premises, is still pending with the Committee on Education, Science & Technology, Arts & Culture, during the 16th City Council. However, due to the end of term of the said Council, all records/documents of pending items were forwarded to the respective Committees of the 17th City Council, for their appropriate action. Thank you.

  8. Thank you for your reply! So if I would be apprehended for what they call as an open pipe violation but then what i really have is an aftermarket pipe complete with muffler and silencer, that would be an illegal apprehension or maybe fabrication of non-existent law?.. thank you so much..

      Sir, Article XVIII, Section 128, Mufflers and Noise Controlling Devices of Ordinance No. 0334-12, Series of 2012, otherwise known as “An Ordinance for the Comprehensive Transport & Traffic Code of Davao City”, states that:

      “No person shall operate a motor vehicle on a street unless such motor vehicle is equipped, at all times, with a muffler or mufflers in constant operation and of sufficient capacity for the motor and equipped with an exhaust system to prevent the escape of excessive fumes or smoke and unusual noise;

      Owners or operators of motor vehicles within the territorial jurisdiction of the City of Davao shall at all times ensure that their vehicles comply with the exhaust emission standards set forth in RA 8749, otherwise known as the “Philippine Clean Air Act of 1999” and its implementing rules and regulations.”

      Likewise, Section 182 of the said Ordinance under Modification of Muffler on motorcycle subject to the provisions of Article XV of this Code, states that:
      “a. It is prohibited for a person to drive a motorcycle or motorcycle with sidecar with modified muffler or detached muffler or without a muffler;
      b. Any person driving motorcycle or motorcycle with sidecar or centercar with modified muffler or detached muffler or without a muffler, aside from payment of fine, shall likewise be penalized by impoundment of the motorcycle unit at the city impoundment area.”

        Hi from the term modified.. Its must be something stock and create something new about it like stock muffler being “kal-kal” they remove the silencer inside the stock muffler to look like stock but the silencer inside is gone already and that is modified while aftermarket mufflers are crested in a factory for a designated displacement and type of motorcycle and it has a ready made silencer with it… So it means after market mufflers are not modified and since it has a ready made silencers enforcers must not impound motorcycles with aftermarket pipes/muffler”branded” that has silencers already???

      • hi, i just want to clarify this. if a motorcycle is using an aftermarket (not stock) muffler. but it has a silencer and it does not produce any unnecessary noise. would the motorcycle be impounded and the driver penalized?? thanks

  9. Sir by the term modified muffler, is it the same as “aftermarket muffler”? or will an aftermarket muffler become a modified muffler once something is done to it?. I am a member of MRO or Motorcycle Rights Organization and would just like to clarify that so that I can inform the members of what they should do and be aware of the law.The term “modified muffler” really is not clear to us riders since no clear definition is being presented to us whenever a member is being apprehended except for the fact that a legal exhaust system is comprised of a pipe, muffler, and silencer.

      Sir, based on the Definition of Terms of Ordinance No. 0334-12 otherwise known as the Comprehensive Transport & Traffic Code of Davao City, the term “aftermath muffler” is not included.

      However, may we suggest that you look up Section 182 of the said Code which provides in detail the provision on “Modification of Muffler on Motorcycle subject to the provisions of Article XV of this Code”, so as to be properly guided. Thank you.

        i am a bike owner and i had an after market exhaust installed on my unit, i was stopped once and got away with a warning (I now reinstalled the old ugly stock muffler). Actually, the aftermarket muffler installed was almost as quiet as the stock but it just looks cooler than the one it came with. Is there any plan to amend this ordinance making it more comprehensive like adding acceptable dB levels standards for each engine size? or a DOT approved aftermarket exhaust system perhaps?

        Sir, under Appendix V, Schedule of Fines and Penalties of Ordinance No. 0334-12, The Comprehensive Transport & Traffic Code of Davao City, the penalty for modification of muffler on motorcycles based on Section 182, Modification of Muffler on Motorcyles, is Five Hundred Pesos (P 500.00).

      As per check with our records, the City of Davao does not have any specific ordinance relative to the building/construction of structures for religious services.

      However, the general guidelines and regulations for construction of buildings is embodied under Republic Act 6541, otherwise known as the National Building Code of the Philippines as well as under Ordinance No. 0546-13, Series of 2013, entitled: “An Ordinance amending the Comprehensive Zoning Ordinance of Davao City..”, for zone classification and reclassifications.

      For further inquiries, may we refer you to the City Engineer’s Office as well as to the Office of the City Planning & Development Office. For your information and guidance.

  28. I thank the City Council for passing an Anti-nuisance Ordinance, this should prohibits the carenderia, sari-sari store with videoke extension with no soundproofing whatsoever. I wonder why this is not implemented strictly like the anti-smoking ordinance. If I may compare, smoking is less evil than this videokes, because even if you are inside your house vibrations and noise from these videoke machines will not let you rest and relax. while just a few feet away from a smoker does not affect you already. I pray the city council to give attention to this issue, only a few of them is being happy while a lot more is suffering, also they dont add any economic contribution but destruction to the community.       Sir, as per check with our Records, a proposed Ordinance regulating the use of sound-producing equipment, gadgets and machines, for appropriate action of the Body, was calendared under Item No. 441 and was endorsed under First Reading last January 21, 2014. The proposed item is now scheduled for committee hearing on February 3, 2014, 2:00 p.m., at the Councilors’ Lounge of the Office of the Sangguniang Panlungsod.

        Sir/Maam, as previously cited Article XV, Prohibited Acts, Omissions and their Penalties under Section 44, sub-paragraph 7 of Ordinance No. 0361-10, Series of 2010, strictly prohibits “the open burning of solid waste”.

        Further, Article VII, Segregation of Solid Waste, sub-divides solid waste into four (4) types: Biodegradable, Recyclable. Residual and Special Waste. Special Waste and Yard Waste in the ordinance are defined as:

        “Special Waste – shall refer to household hazardous wastes such as paints, thinners, household batteries, lead-acid batteries, spray canisters and the like. These include wastes from residential and commercial sources that comprise of bulky wastes, consumer electronics, white goods, yard wastes (underscoring for emphasis only) that are collected separately, batteries, oil and tires. These wastes are usually handled separately from other residential and commercial wastes;

        “Yard Waste – shall refer to wood, small or chipped branches, leaves, grass clippings, garden debris, vegetable residue that is recognizable as part of a plant or vegetable and other materials identified by the National Solid Waste Management Commission.

    Pleasant morning I would just like to ask if aftermarket muffler with silencer already is prohibited here in Davao city cause aftermarket mufflers are not modified mufflers like nob1,yoshimura,namban,hgm, his speed etc. They have mufflers for designated type and displacement of motorcycle yes it creates a loud noise thats why they put silencer already and all for all of us riders”byahero” its a big factor of our safety of having not too silent not too loud mufflers because stock pipes are too silent that even other driver can’t notice us riders unlike aftermarket muffler that has silencers.. Can I suggest that they must put a decibel limit like max of 100-110db only but how about chopper bikes and other higher CC bikes?? They create a very loud noise with their stock pipe because they have a higher CC they could be noticed by our driver so they could see where the big bike is going… So it means big bikes can be impounded because they could create a loud noise?

    All I can say is that you guys must revise it
    1.without db meter enforcers cannot impound the motorcycle “city ordinance must have a db limit to follow”
    2. Loud pipes save life “but not too loud”
    3. And since mufflers has decibel limit already revolution more than twice to attract other driver is not allowed esp. In stoplight

When I was about to pass by the lto checkpoint last week here in Martina they called my attention to park for awhile and one officer approached me and said my muffler is prohibited because its bora2 and I said the davao city law clearly clearly states that modified mufflers is not allowed here in Davao city not aftermarket muffler that has silencer so after that they let me pass but when my friend was about to pass at the same checkpoint he was called by the lot officer to park for awhile for inspection and the same violation that they told me but sadly my friend never red or knew about the law regarding modified muffler, so he was issued a ticket with a violation of illegal muffler”bora2″ and his license and plate was confiscated but actually it was not bora2 because it has silencer and it is an aftermarket muffler just like mine… Namban version 4 with silencer made in Thailand. If the law clearly states that modified muffler is not allowed not aftermarket mufffler bat ginawa nila yun Sa barkada ko?? Dhil di nya alam ang law about muffler?? Aftermarket mufflers are not modified mufflers so why does lto keeps on confiscating license and palate number of riders that has aftermarket mufflers with silencer not modified muffter?

      Sir, Sub-paragraph (b) of Section 182, Modification of muffler on motorcycle subject to the provisions of Article XV of this Code, under Ordinance No. 0334-12, Series of 2012, entitled as “An Ordinance for the Comprehensive Transport and Traffic Code of Davao City”, provides that:
      “(b) Any person driving motorcycle or motorcycle with sidecar or centercar with modified muffler or detached muffler or without a muffler, aside from payment of fine, shall likewise be penalized by impoundment of the motorcycle unit at the city impoundment area”.

      However, as the said provision does not clearly define what constitutes modified mufflers, may we refer you to the Land Transportation Office (LTO) Region XI, for the guidelines on the same.

We would like to review the guidelines regarding the ordinance for future clients in the Davao area.

    The new City Zoning Code and Comprehensive Land Use Plan, even if Labeled Preliminary, need to be posted on-line here on this City site. It will most likely solve most of the cost of copying, trips to the SP and vastly improve compliance. Why will it improve compliance? Compliance will be improved because now more of the public will know what the rules are, both for themselves and “Concerned Residents” to alert the council and other administrative bodies of violations. It possibly may also assist in reducing corruption for the same reasons.

    I have a question about the legality of putting dirty laundry water on city streets.

    A neighbor in our subdivision apparently does not have an underground drain system in their outdoor laundry area connected to the wastewater canal system in our subdivision. Instead, they manually sweep the water through an above-ground pipe that empties directly onto the street and, since their house is built on a slight incline, at the top of a hill, the dirty laundry water runs down the road toward other resident’s homes. There are many children who play in the area, on the street, and may get the dirty water on their shoes or their hands. Also, a number vehicles drive through this wastewater, spreading it about and putting it on their vehicles. This can’t be a good health or sanitation situation.

    I’m wondering, is it illegal in the city of Davao to dispose of personal household wastewater, like dirty laundry water, by intentionally directing it onto the street?

      1. CURFEW ORDINANCE
      The Curfew Ordinance of the City was approved under Ordinance 84-71 Amending Section 1, 4 and 5 of Ordinance No. 26, series of 1952, otherwise known as the Curfew Ordinance of the City of Davao, the same to read as follows: “SEC. 1.- It shall be unlawful for any child below sixteen (16) years of age to be loitering around after seven (7) o`clock in the evening unless they are in company with their parents or guardians; and for any such child to be sleeping in public places like the markets, wharves, empty bodegas or houses, sidewalks or alleys, show houses, etc.

      However, another ordinance specifically the Davao City Children’s Welfare Code or Ordinance No. 2491-94, Series of 1994 was approved in 1994 which provided for:
      “Section 18. Curfew on Minors. For the protection of the child below 15 years of age, they shall be prohibited from loitering around or sleeping in public places after 10 o’clock in the evening until 4 o’clock in the morning of the following day unless they are in the company of their parents or guardians.

      This was later amended by Ordinance 0292-06, Series of 2006, particularly Section 22, which provides that:

      Section 22. Rescue of Children under Special Circumstances. For the protection of children below 15 years of age, they shall be rescued by the BCPC and CSSDO when found loitering around or sleeping in public places, after 10:00 o’clock in the evening until 4:00 o’clock in the morning of the following day unless they are in the company of their parents or guardians. The social worker in the barangay, or any available personnel from the CSSDO shall initiate the rescue and accompany these children in turning them over to their respective barangays. The same rescue operation shall be conducted on children inside disco pubs, videoke establishments, internet cafes and other similar establishments.

      Sir, the City of Davao has approved and enacted Ordinance No. 0325-15, “An ordinance closing off the City of Davao to mining operations”, which is posted in the ONLINE LANDMARK LEGISLATION facility of this website.

      However, the PDF file of the same was not yet uploaded by the City Information & Technology Center, the office which handles and uploads Landmark ordinances of the City of Davao in this website. We have, however, emailed you a PDF copy of the same.

      Further, pursuant to Article Six of Ordinance 158-05, Series of 2005, otherwise known as “An Ordinance approving the 2005 Revenue Code of the City of Davao, as amended” provides for the Tax on Sand, Gravel and other Quarry Resources, a PDF copy is already uploaded in the ONLINE LANDMARK LEGISLATION facility of this website.

  105. good day sir may i know the if am i right that the liquor banned here in our beloved city of DAVAO as amended already is from 1am to 8am in the morning? correct me if i am wrong, my situation is i have a small store here in brgy. bucana 76-A , it confused me when our voluntary brgy tanod as printed on their uniform told me not to sell liquor starting at 10pm based on our city ordinance. even though i know that 1am to 8am is the time of liquor banned stated on our ordinance. since they are person in authority all i have to do is to follow, but every time i will not give to my customer at 10pm they go to others store located few meters away from my store then they can buy. i dont know what went wrong then our tanod do nothing, for me if you imposed the law it should be to all, not for the few. correct me if im wrong sir thank you and more power…
